HRH EZE UCHEAGA FILES MOTION OF APPEAL AGAINST HIS REMOVAL
HRH Eze C A Ucheaga has filed an appeal to challenge the ruling of Umuahia High Court, which removed him as the traditional ruler of Laguru Autonomous Community.
The High Court Judge had directed Abia State Governor to withdraw the staff of office from HRH Eze C.A Ucheaga and issue same to Chief Brown Ngaddi Anozie
While delivering the judgement, justice Chido Nnamani affirmed that the process that brought HRH Eze Ucheaga to the throne was irregular, declaring them null and void, He consequently ordered him to vacate the stool and the office of the traditional ruler of Laguru autonomous community. The judge held that the monarch was not from Azuemune, the zone whose turn it was to produce the successor to the previous Enyi 1 of Laguru, Late Eze G. Onuoha, describing his election as irregular and a breach of the provisions of Laguru Chieftaincy Laws and Customs
But HRH Eze Ucheaga swiftly rejected the ruling and described it as miscarriage of justice
Weeks latter he filed an appeal before the Owerri division of the Court of Appeal
In the 4 grounds of appeal filed on Wednesday, Chief Ucheaga is praying the court for an order, setting aside the whole judgement of the court.
He is equally seeking an order striking out the suith for want of competence and jurisdiction, in the alternative an order of the court dismissing the suith
The certified true copy of the notice of appeal which was obtained by our correspondent is dated 29th March, 2023 and signed by his counsel.
