LAGURU EZESHIP TUSSLE: ANXIETY AS COURT DETERMINES HRH EZE (PROF.) UCHEAGA'S FATE

 



A High Court sitting in Umuahia, Abia State has fixed 9th March, 2023 for the judgement of the case between Chief Brown Ngaddi Anozie and HRH Eze (Professor) C.A  Ucheaga on the choice of Prof. Ucheaga as the traditional ruler of Laguru Autonomous Community.


Recall that on 17th June, 2021, the Executive  Governor of Abia State, Dr Okezie Ikpeazu  presented the Staff of Office to HRH Eze (Prof.) Ucheaga, bringing to an  end  every dispute pertaining to the selection process.


Chief Brown Ngaddi Anozie, an aggrieved factional Eze-elect has approached the court in Umuahia, seeking an order of the court to compel the Governor of Abia State to withdraw the staff of office earlier presented to HRH Eze C.A Ucheaga.

He also wants the court to direct the governor to present the Staff of Office and Instrument of Appointment to him, having come from the zone whose turn it is to produce the next Eze to succeed HRH Late Eze Godwin Onuoha, the Enyi I of Laguru.

The presiding judge, justice Nwakanma had fixed the 9th March date for judgement on the case after counsels for both the defendant and the plaintiff have presented their arguments to the court.

While the counsel for Chief Anozie prayed the court to grant the prayers of his client, arguing that succession to the throne is by rotation and that HRH Eze Ucheaga  is not from the zone whose turn it is to produce the successor to Late Eze Godwin Onuoha as enshrined in the constitution of Laguru Autonomous Community, but the counsels for both HRH and the Governor opposed the prayers and urged the court to dismiss the case on following grounds

a) That the plaintiff does not have the locus standi to institute the case in the first instance as he neither purchased  nor filed  the nomination form for  his purported election as the 'Eze-elect' of Laguru Autonomous Community

b) That the constitution he was referring to, has been amended and therefore can not hold

c) That the governor has the constitutional right to present the staff of office to who so ever he deems fit and that he can only withdraw the staff of office from such person when he is convicted by a court, incapacitated, dead or dethroned.

They maintained that no individual no matter how highly placed has the right to force government on what decision to take

Ubscope gathered that since HRH Eze (Prof.)  Ucheaga was given the staff of office by the Governor of Abia State, Oyimo village, the apex village in Azuemume zone have refused to recognise him as the traditional ruler of Laguru. They had stayed away from his coronation and have refused to associate with him since then.




The two factional Ezes-elect, Chief Brown Ngaddi Anozie and Deacon Obioma Ogbonna, from the village had gone to the court to challenge the governor on his choice of Dr Ucheaga as the traditional ruler of Laguru, despite the olive branch HRH has extended to them.



During the last quarter of  2022, the anti Eze Ucheaga's camp suffered a set back in their quest to withdraw the staff of office from him, as a High Court sitting in Umuahia dismissed the suit filed by one of the factional Ezes-elect, Deacon Obioma Ogbonna  for abuse of court process

Despite Deacon Obioma Ogbonna's loss,  Chief Anozie's camp believe that he will get favourable  judgement from the court on 9th March " Chief Brown Anozie has a strong case against Prof. Ucheaga. It is turn by turn according to the constitution. It is the turn of Azuemume zone and not Amato. Prof.  Ucheaga is not  from Azuemune. He is from Amato zone. Chief Anozie is from the zone. He is the rightful person to be given the staff of office"

Many of Prof. Ucheaga's loyalists have  however expressed dismay over Chief Anozie's action to continue with the case at the court instead of withdrawing it by now especially when it has been revealed that he did not even purchase nomination form for his election as Eze and also considering his age and frail  health

They wonder why he should be wasting his time and resources on litigations when it would have been proper for him to join hands with HRH to bring the needed development in Laguru Community.

" We are very confident that HRH Eze Professor Ucheaga, the Enyi II of Laguru Autonomous community will win in the court. He has been given staff of office by the governor and coronated. Like what Chief Anthony Ukasanya said during his coronation  The choice of Dr Ucheaga as the traditional ruler is irreversible. All efforts to make the governor withdraw  the staff of office from him are efforts in futility and share waste if time and resources"  One of them told UbscopeNews
